David Flick, Principal and Founder, announces that the firm successfully renewed the Section 404/401 Clean Water Act permitting for the Kellybrooke Single Family Residential Development in Clay County, Missouri. When constructed, t he project will help to meet the demands of the increasing population within the northern Kansas City area.
Scientists with Terra Technologies had previously completed a jurisdictional assessment of potential waters of the United States within the limits of the proposed development project. The Army Corp of Engineers and Missouri Department of Natural Resources concurred that wetlands and an ephemeral stream would be impacted. The applicant is required to preserve 1,384 linear feet of a riparian buffer adjacent to an existing ephemeral stream channel. The Corp of Engineers added a special condition relating to an endangered species, the Northern Long Eared Bat. Developer is restricted from clearing timber only during the hibernation period, which is from November 15 to April 1.
Due to the permanent loss of wetlands, mitigation credits were purchased from the Clear Fork Wetland and Stream Mitigation Bank where such surface waters are preserved through perpetuity under management by Terra Technologies.
