David Flick, Principal and Founder, announces that the firm successfully completed Section 404/401 Clean Water Act permitting for the Eagle Heights development in Smithville Missouri. When constructed, the development will help meet the demand for single family lots in the Smithville area.
Nationwide Permits that authorize impacts to jurisdictional waters resulting from most projects are limited to 300 feet of tributary impacts. When requested by the applicant, the US Army Corps of Engineers can evaluate the merits of waiving the 300 foot limitation when impacts occur to a tributary whose function is impaired prior to impact. Impairments are often associated with the absence if riparian corridors and other stream impacts upstream and downstream from the project site.
Scientists with Terra Technologies completed a jurisdictional assessment of potential waters of the United States within the limits of the proposed development project. Two intermittent streams totaling 2,114 linear feet, two ephemeral streams totaling 604 linear feet, and one wetland totaling 0.23 acres were delineated at the site.
To replace the lost aquatic resources that result from the authorized project, the permittee must purchase credits from Nishnabotna/Platte Rivers Umbrella Bank, where such surface waters are preserved through perpetuity under management by Terra Technologies.
