David Flick, Principal and Founder, provided technical assistance in the use of a US Army Corps of Engineer Clean Water Act Section 404 Conservation Easement to preserve and protect 15-acre of existing intermittent stream and associated riparian corridor in partial satisfaction with compensatory mitigation resulting from planned construction of the Cleveland Lake Flood Control Project in Belton Missouri.
Use of land for mitigation follows a strict and complex set of regulations enacted in 2008 by the Corps of Engineers. Preservation and enhancement of existing stream corridors may represent allowable compensatory mitigation offerings. All mitigation parcels are required to be legally protected from site disturbance by the assignment of a conservation easement to an approved authority. Mr. Flick coordinated such discussions with the Midwest Mitigation Oversight Association Inc, a local non-profit corporation established solely to hold and provide oversight of such easement conditions. All work was performed on a volunteer basis to assist City Staff in the achievement of compliance to Clean Water Act Section 404 permit conditions.
