David Flick, Principal and Founder, announces that the firm successfully completed Section 404/401 Clean Water Act permitting for the second phase of the Archers Landing at Sundance Ridge Residential Development in Overland Park Kansas. The development will help meet the demand for residential homes in southeastern Overland Park.
Scientists with Terra Technologies completed a jurisdictional assessment of potential waters of the United States and to document existing site conditions. The development phase is approximately 87 acres in size and consists of agricultural and forested land. A total of 652 lineal feet of ephemeral stream channels were delineated on the property. The Corps of Engineers waived the 300 linear foot limit because of the degraded condition of the ephemeral channels.
The applicant received a Nationwide Permit 29 verification letter authorizing unavoidable impacts to jurisdictional surface waters. To replace the lost aquatic resources resulting from site grading, mitigation credits will be purchased from the Kansas and Missouri River Umbrella Mitigation Bank Site 2 serving the project watershed. The compensatory mitigation credit purchase must be completed prior to the commencement of work within the regulatory jurisdiction.
For more information about Clean Water Act Section 404 Nationwide Permits that may qualify for a waiver of the 300-foot rule, please contact your local office of Terra Technologies.
