David Flick, Principal and Founder, announces that the firm has received an Approved Jurisdictional Determination from the US Army Corps of Engineers confirming the absence of surface waters subject to regulation by Section 404 of the Clean Water Act.
Jurisdictional determinations are issued by the Corps to identify the type, location, and extent of waters subject to regulation. Although wetland, ponds, and drainage features may be present on a proposed development parcel, not all waters are subject to jurisdiction. In such instances, scientists with Terra Technologies complete Jurisdictional Assessments to characterize the extent and function of such waters. When such waters are clearly exempt from regulation, the developer is entitled to a formal determination confirming the absence.
It is advantageous for property owners to formally consult with the US Army Corps of Engineers to have a determination in hand prior to the initiation of site grading. With such a determination confirming absence of waters, the developer is assured the absence of a federal nexus, simplifying the environmental clearance process.
